1. About PartywitMe 

PartywitMe (“we”, “our”, “us”) is an online platform and mobile application that lets users create, promote and manage events, issue invitations, and sell or distribute tickets. 

2. Eligibility & Accounts 

• You must be at least 18 years old (or the age of majority in your jurisdiction) to host free or paid events or purchase tickets. 

• You are responsible for safeguarding your login credentials and all activity under your account. 

3. Event Creation & Content 

• Organizers may create public or private events, free or paid. 

• When you create an event, you provide details and images (“Event Content”). You confirm that you have the necessary rights to use and upload that content. 

• You grant PartywitMe a non-exclusive, worldwide license to display, adapt and promote Event Content in connection with the Service. 

• Organizers are solely responsible for the accuracy of event details, compliance with local laws, and delivery of events. 

4. Fees & Payments 

• Current pricing: PartywitMe does not currently charge a platform fee for ticket sales or guest invitations at this time. 

• Payment processing: All paid transactions are handled by Stripe. Stripe currently charges a processing fee of US $0.50 per ticket (or otherwise displayed at checkout). This fee is deducted automatically. 

• Future platform fee: PartywitMe reserves the right to introduce a platform commission of up to 30 % of ticket face value. You will receive at least 30 days’ notice before any such change takes place. Continued use of the Service after the notice period constitutes acceptance of the new fee. 

• All prices, fees and taxes are shown (or added) at checkout. Organizers are responsible for remitting any applicable taxes on ticket revenue.  

5. Ticket Sales & Invitations 

• A ticket purchase forms a contract between the buyer and the organizer, not PartywitMe. 

• Buyers may accept or decline invitations.  

• PartywitMe is not liable for event cancellations, quality, safety or any losses arising from attendance (see Section 9). 

6. Refunds & Cancellations 

• At this time, PartywitMe does not process refunds for ticket purchases. All ticket sales are considered final. Organizers are encouraged to clearly state any refund or cancellation policies in their event description, if applicable. 

7. User Obligations & Prohibited Conduct 

You agree not to: 

1. Post unlawful, infringing, or misleading content. 

2. Use the Service for fraud, spamming, or unsolicited marketing. 

3. Interfere with the security or proper functioning of the platform. 

4. Sell counterfeit or unauthorized tickets. 

8. Intellectual Property 

All PartywitMe software, trademarks and branding remain our property. Except for Event Content you upload, you may not reproduce or distribute any part of the Service without written consent. 

9. Privacy 

We collect and process limited personal data in accordance with our Privacy Policy. 

10. Disclaimers & Limitation of Liability 

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law: 

• PartywitMe disclaims all liability for events organized through the platform or any indirect, incidental or consequential damages; 

• Our total aggregate liability arising out of or in connection with the Service shall not exceed the greater of (a) the total platform fees you paid us in the 12 months preceding the claim, or (b) US $100. 

• PartyWitMe and its affiliates are not liable for any impersonation, incidents, accidents, or conflicts that arise at any stage of planning or creating invitations for both public and private events. The host/organizer and his/her associate are solely responsible.  

11. Indemnity 

You agree to indemnify and hold PartywitMe, its affiliates and employees harmless from any claims, damages or expenses arising from your (i) use of the Service, (ii) Event Content, or (iii) breach of these Terms. 

12. Termination 

We may suspend or terminate your access at any time for violation of these Terms or applicable law. You may close your account at any time. 

13. Changes to These Terms 

We may modify these Terms from time to time. Material changes will be notified via email or in-app notice at least 30 days before they take effect. 

14. Governing Law & Disputes 

These Terms are governed by the laws of PA, United States. Any disputes shall be resolved in the courts of that jurisdiction.
